The following Terms of Service Agreement (the “TOS”) is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with WCA World Coach Association Corp, also known as WCA World Career Academy, located at 3522 N Powerline Rd., Pompano Beach, FL 33069, and our subsidiaries and Affiliates, in association with the use of the website, which includes wcacareeracademy.com, (the “Site”) and its Services, which shall be defined below.
The Site is a news and information website training which has the following description: To train and equip HVAC technicians with useful, high-quality information. All visitors to our site shall be deemed as “users” of the herein contained Services provided for the purpose of this TOS. The user acknowledges and agrees that the Services provided and made available through our website and applications, which may include mobile applications and those available on various social media networking sites and downloadable programs, are the sole property of WCA World Career Academy. At its discretion, WCA World Career Academy may offer additional website Services and/or products, or update, modify, or revise any current content and Services. Your continued use of the Services shall constitute acceptance of any such updates, changes, or modifications.
Every member's registration data and various other personal information are strictly protected by the WCA Online Privacy Policy (see the full Privacy Policy at wcacareeracademy.com/privacy-policy). As a member, you consent to the collection and use of your information, including its transfer within the United States and/or other countries for storage, processing, or use by WCA and/or our subsidiaries and Affiliates.
Upon registration, you acknowledge that using wcacareeracademy.com to send electronic communications (including email, searches, instant messages, file uploads, photos, and/or videos) will result in transmissions through our computer network and interstate communications.
Due to the global nature of the internet, you agree to comply with all local rules relating to online conduct and acceptable content. Uploading, posting, or transferring software, technology, and other technical data may be subject to export and import laws of the United States and other countries. You further agree to comply with all applicable export and import laws, including the Export Administration Regulations (http://www.access.gpo.gov/bis/ear/ear_data.html) and the U.S. sanctions control program (http://www.treasury.gov/resourcecenter/sanctions/Programs/Pages/Programs.asp). WCA does not claim ownership of any content submitted by any visitor or user, nor is such content made available for inclusion on our Services. By submitting content, you grant WCA a worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform, and display that content solely for the purpose of providing and promoting the area where the content is placed. This license remains in effect as long as you are a member of our sites.
WCA World Career Academy provides an area for users to contribute feedback. When you submit ideas, documents, suggestions, or proposals (“Contributions”), you agree that:
You agree to indemnify and hold harmless WCA, its subsidiaries, Affiliates, agents, employees, officers, and partners from any claims, demands, or damages (including reasonable attorney fees) arising from any content you submit, post, modify, transmit, or otherwise make available through our Services or from your violation of these Terms.
You agree not to replicate, duplicate, copy, trade, sell, resell, or exploit any part of WCA’s sites for any commercial purpose.
WCA World Career Academy reserves the right to modify, alter, or discontinue, temporarily or permanently, any part of our Services without prior notice. You agree that WCA shall not be liable for any such changes, suspensions, or discontinuances.
Any dealings with advertisers on or through our Services are solely between you and the advertiser. WCA is not responsible for any loss or damage incurred from such dealings.

You acknowledge that WCA Services and any associated software contain proprietary and confidential material protected by intellectual property rights. Except as expressly permitted by law or authorized by WCA, you agree not to alter, modify, rent, sell, distribute, or create derivative works from WCA Career Academy Services or Software.
YOU ACKNOWLEDGE THAT THE USE OF WCA WORLD CAREER SERVICES AND SOFTWARE IS AT YOUR SOLE RISK. OUR SERVICES AND SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. WCA DOES NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, nor that any errors will be corrected. All downloads or use of information is at your own risk.
YOU ACKNOWLEDGE AND AGREE THAT WCA ACADEMY AND ITS RELATED PARTIES SHALL NOT BE LIABLE FOR ANY PUNITIVE, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING (BUT NOT LIMITED TO) DAMAGES RELATED TO LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM:
In the event of any dispute, you agree to release WCA CAREER ACADEMY (and its officers, directors, employees, agents, parent companies, subsidiaries, affiliates, co-branders, and partners) from all claims, demands, and damages—both actual and consequential—arising out of or related to such dispute.
If you intend to create or join any service, or receive information concerning companies, stock quotes, investments, or securities from our Services, please review the Warranty Disclaimers and Limitations of Liability sections again. WCA's content is provided for informational purposes only and is not intended for trading or investing. WCA is not responsible for any trading or investment decisions made based on this information.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Therefore, some of the above limitations may not apply to you.
Unless expressly provided otherwise in this TOS, there are no third-party beneficiaries to this agreement.
WCA may send you notices regarding changes to this TOS via email, mail, MMS, SMS, text messaging, postings on our website, or other reasonable means. Such notices may not be received if you access our Services in an unauthorized manner. Your use of our Services confirms that you have received all such notices.
All trademarks, copyrights, trade names, service marks, logos, and brand features associated with WCA are the property of WCA. You agree not to display or use the WCA logo or marks without obtaining prior written consent.

This TOS constitutes the entire agreement between you and WCA CAREER ACADEMY and supersedes any prior version of this TOS with respect to WCA Services. Additional terms may apply when using or purchasing certain other WCA Services, Affiliate Services, third-party content, or software.
The relationship between the parties shall be governed by the laws of the State of Florida without regard to its conflict of law provisions. Any claims or disputes arising out of or related to this TOS or your relationship with WCA shall be filed in the courts located in Broward County, Florida, or in the appropriate U.S. District Court. You agree to submit to the jurisdiction of such courts.
If WCA fails to exercise or enforce any right or provision of this TOS, such failure does not constitute a waiver of that right or provision. If any provision of this TOS is deemed invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
You acknowledge and agree that any claim or action arising out of or related to the use of our Services or this TOS must be filed within one (1) year after the claim or cause of action arises, or it will be forever barred.
